Contrairement à la pratique, l’homme d’affaires Kabirou Mbodje n’a pas eu droit à la présomption d’innocence dans son propre pays lorsqu’il a été accusé de viol par deux marocaines et une nigériane en une nuit, à Paris, la semaine dernière. La presse sénégalaise avait l’habitude de défendre tous les Sénégalais à l’étranger, mais cette fois-ci, ce n’est pas le cas. Le lynchage médiatique dont a fait l’objet cette grande fierté sénégalaise, en proie à des difficultés depuis qu’il a voulu racheter Tigo en 2018, semble trahir cette «haine de soi» que certains psychologues détectent parfois chez nous, avec une propension à mettre une énergie folle à détruire les réussites sénégalaises.
Comme Icare, à force de vouloir trop s’approcher du Soleil, l’homme d’affaires Kabirou Mbodje a vite fait d’apprendre qu’il allait se faire brûler les ailes. Pis, par les siens. Très entreprenant, il a fait montre d’une innovation qui a révolutionné le secteur du transfert d’argent avec son label Wari qui a connu un franc succès sur le continent africain. Mais, depuis que l’homme d’affaires a annoncé sa volonté de racheter la filiale sénégalaise du groupe américain Millicom international Cellular (Mic), pour marquer son entrée dans ce secteur lucratif des télécoms avec son levier de monétique, il a braqué tous les projecteurs sur lui. Depuis, il ne fait que rencontrer des difficultés de tous ordres. Et cette dernière affaire d’accusation de viol en date vient s’ajouter à la longue liste de choses invraisemblables qui jusqu’ici n’ont pourtant pas eu raison de lui.
En effet, connaissant les autorités françaises sur des dossiers pareils, c’est sans doute parce que les déclarations des accusatrices, deux marocaines et une nigériane, ne tiennent pas trop que l’homme d’affaires s’en tire avec un placement sous contrôle judiciaire. Parce qu’il sont obligés de recevoir les plaintes et d’écouter toutes les parties dans ce dossier où notre compatriote semble être piégé. Car, d’après, certaines sources proches du dossier, c’est sur l’insistance de ses accusatrices et de leur complice qu’il a accepté de les recevoir chez lui pour «un dernier verre» après la fermeture de l’endroit où ils ont tous passé la soirée. Et c’est là que notre compatriote qui ne comprenait pas l’arabe que parlaient les Marocaines est finalement tombé dans le guet-apens. S’en est suivi ce que l’on sait avec les relais au Sénégal où Kabirou Mbodje compte de puissants ennemis dans les milieux d’affaires affiliés à une certaine presse.
Cependant, ce «piège à cons» risque de révéler une manigance invraisemblable et un complot qui va se retourner contre ses auteurs. Cela, à cause des nombreux messages et coups de téléphone entre les différents acteurs en un temps record. Des filles qui ne se connaissent pas et qui portent plainte en même temps et ayant la même avocate. Autant de bizarreries… Mais ce qui choque le plus, au Sénégal, c’est qu’on n’a pas semblé lui accorder la présomption d’innocence. Parce que, dès que l’affaire a été annoncée, l’homme d’affaires a fait l’objet d’un lynchage médiatique, avec la seule source médiatique du journal Le Parisien alors qu’il est innocent jusqu’à preuve du contraire. Heureusement que nos confrères du quotidien L’Observateur ont pu donner un autre son de cloche avec l’avocat de l’accusé, Me Philippe Zeller. Lequel a relevé de nombreuses «coïncidences troublantes» dans les déclarations des accusatrices sans entrer dans les détails. Hommes d’affaires en sursis ? D’un autre côté, cette affaire doit alerter l’opinion publique sur le phénomène «me-too» qu’on doit absolument arrêter. Parce que souvent utilisé comme arme fatale contre les gens soupçonnés d’avoir de l’argent en les accusant de viol, impossible d’infirmer, même en cas de vengeance après une liaison. Et parfois, c’est la voie ouverte à des raquettes organisées sur les élites africaines. Car, d’autres gens fortunés comme lui ont été accusés au sein même de leur famille. Mais, on entend rarement ce genre d’accusation sur des personnes lambda.
C’est toujours de gros bonnets ou des politiques.
Même si cela ne veut pas dire que cela n’existe pas. Mais la façon dont ces choses sont montées en épingle prouve qu’il y a un procédé mis en place pour nuire aux personnes citées. Et on ne se rend pas compte du préjudice moral causé aux personnes incriminées. Ce qui est catastrophique, alors que pour la femme menteuse, la sentence est minime. Mais pour l’homme, les choses sont terribles, difficilement réparables. Rien que la perception que les gens ont de vous est grave. C’est un Sénégalais vivant à l’étranger, on lui doit le respect de la présomption d’innocence.
Le ministre de l’Intérieur français Gérald Darmanin a été accusé et blanchi pour des faits similaires. Son pays lui doit au moins une chose: le respect de la présomption d’innocence qui est universelle, sans préjuger de la décision que les juges prendront.
