Le ministre de la Justice n’en démord pas : que les magistrats restent à leur place et respectent les prérogatives du chef de l’Etat en acceptant que l’initiative des lois de la République est de son seul ressort. Pour lui, Macky Sall les a suffisamment écoutés, raison pour laquelle il a fait passer de six ans à trois ans la prolongation du mandat de son homme lige à la tête de la Cour suprême et a décidé d’en faire bénéficier au procureur général près la Cour suprême, aux présidents de chambre de cette juridiction et aux premiers présidents et procureurs généraux des cinq Cours d’appel, soit au total seize magistrats sur les 517 que compte le Sénégal. Et, plutôt que de pousser le bouchon plus loin, ils devraient au contraire se soumettre, au vu de tous les importants acquis pour la corporation, dont est porteuse la réforme du statut des magistrats.
S’ils laissent passer le projet de loi organique comme le leur demande le Garde des Sceaux, le Premier président de la Cour suprême Mamadou Badio Camara ne fera plus valoir ses droits à la retraite dans six mois, mais plutôt en avril 2020 (ha le veinard !). Pour Macky Sall comme pour son ministre de la Justice, tel est le seul but visé par cette réforme. C’est pour noyer le poisson qu’ils ont fait bénéficier de cette mesure, dans un premier temps, au procureur général de la Cour suprême, Cheikh Tidiane Coulibaly. Et c’est dans cette même optique de jeter de la poudre aux yeux de l’opinion, qu’ils ont fini par élargir la mesure aux présidents de chambre de la Cour suprême et aux présidents et procureurs généraux près les Cours d’appel. Avoir à la tête de la Cour suprême, un homme prêt à tout pour rester dans les bonnes grâces du pouvoir exécutif vaut bien tous les sacrifices, même celui de créer une discrimination négative entre les membres d’une même corporation.
Seulement, si le président de la République suit son Garde des Sceaux dans sa volonté de passer outre l’hostilité de l’écrasante majorité des magistrats au «projet de loi Badio Camara», il risque d’installer le pays dans une grave crise. Parce qu’en faisant passer l’âge de la retraite de seize magistrats de 65 à 68 ans au motif que la magistrature a si grandement besoin de cette expertise qu’ils ont accumulée avec l’âge, il donnera, à n’en point douter, des idées pour une plateforme revendicative aux enseignants du supérieur. Et ainsi il ouvrira la boîte de Pandore. Car qui plus que l’Université a besoin de ses professeurs titulaires de chaire qui, comme le bon vin, se bonifient avec l’âge. Parce qu’entre 2010 et 2017, l’Université Cheikh Anta Diop de Dakar devrait perdre, en tout, les deux tiers de ses professeurs titulaires de chaire, frappés qu’ils sont par la limite d’âge de 65 ans qui leur est appliquée, comme les magistrats, en tant que fonctionnaires de la hiérarchie A1 spéciale.
Le plus inquiétant, c’est qu’en 2016, toute la faculté des Sciences juridiques et politique de l’Ucad ne compte que quatre professeurs titulaires de chaire. Alors qu’à la faculté des Lettres et Sciences humaines, tous les départements réunis ne comptent pas plus de vingt-cinq professeurs titulaires de chaire. Et la plupart de ces profs sont à quatre à six ans de la retraite. Si des hauts magistrats peuvent bénéficier d’une rallonge de trois ans, pourquoi pas ces professeurs titulaires dont les départs massifs à la retraite contribuent pour beaucoup à la baisse du niveau aussi bien des jeunes enseignants que des étudiants.
Une grève des enseignants de toutes les universités du Sénégal réclamant l’alignement des professeurs titulaires sur les si choyés hauts magistrats de Macky Sall n’est pas une simple vue de l’esprit si les autorités ne se ravisent pas. Les pouvoirs publics sont avertis : ils ont plus à craindre la réaction des universitaires qui sont adossés à un puissant et combatif syndicat, le Saes, que celle des magistrats qui ne sont pas syndiqués.
PS : Une pensée pieuse pour toutes les victimes de crimes crapuleux de ce violent mois de novembre – le plus violent de tous les temps au Sénégal ? – et un appel pressant au «Lion qui dort» pour qu’il se réveille enfin et s’attèle à éradiquer cette pauvreté et ce désœuvrement de la jeunesse qui sont la source de toutes les violences et de l’insécurité galopante.
