CONTRIBUTION
L’Assemblée nationale du Sénégal a adopté, le 10 décembre 2021, le projet de loi rétablissant le poste de premier ministre. La loi a été promulguée et publiée au journal officiel, le 22 décembre 2021.
Or, plus d’un mois et demi après la promulgation de la loi (exécutoire), le Sénégal se retrouve toujours sans premier ministre et sans nouveau gouvernement : un bazar inédit qui, de fait, peut déboucher sur une crise politique et institutionnelle.
L’exposé des motifs du projet de loi soumis au Parlement précisait que le rétablissement du poste de Premier Ministre a pour objet de répondre aux besoins d’efficacité « afin de prendre en compte les impératifs de relance de l’économie nationale et d’une meilleure coordination de la mise en œuvre des politiques publiques ».
En décidant de rétablir le poste de Premier Ministre, Macky Sall était censé avoir déjà arrêté son choix sur la personne qui devait assurer la coordination de l’action gouvernementale, car « les impératifs de relance de l’économie nationale énoncés par l’exposé des motifs sont incompatibles, avec les louvoiements de Macky Sall et la situation de blocage institutionnel actuel du pays ».
A ce jour, rien ne justifie la non nomination d’un Premier Ministre, si ce n’est l’amateurisme, l’indécision et le manque d’autorité de Macky SALL, dont les cyniques calculs politiques ne se sont pas déroulés comme prévu, lors des élections locales du 23 janvier 2022 (il avait cru à une razzia de Benno BOK YAKAAR).
Dans le contexte actuel de crise intérieure (crise économique, crise politique, crise des enseignants, cherté de la vie), et de tensions au niveau de la sous-région, (situation au Mali), un Premier Ministre doit être nommé dans les plus brefs délais. Le blocage institutionnel actuel est inacceptable et nuit gravement au fonctionnement de l’Etat, au moment où les ministres sont sur le départ et gèrent les affaires courantes.
Macky Sall doit cesser de jouer avec les institutions du pays et appliquer les dispositions de l’article 49 de la Constitution (tel que prévu par la loi constitutionnelle n° 2019-10 du 14 mai 2019) : « Le Président de la République nomme les membres du Gouvernement, fixe leurs attributions et met fin à leurs fonctions ».
Ne nous y trompons pas : les tergiversations et les lenteurs liées à la nomination du Premier Ministre et la formation d’un nouveau gouvernement n’empêcheront nullement l’opération « dogali » lors des législatives à venir.
