CHRONIQUE DE PAPE NDIAYE
Depuis la mutinerie de Rebeuss qui s’est soldée par un mort d’homme et 41 blessés (selon le bilan officiel), aucune mesure conservatoire n’est encore prise à l’endroit des auteurs présumés de ce drame survenu en milieu carcéral. Pourtant, plusieurs régisseurs ont été relevés de leurs fonctions, à cause de faits moins graves que ce qui s’est passé à la prison centrale de Dakar. Le dernier cas implique l’inspecteur Mohamed Lamine Diop, affecté à un autre service, pour le simple fait d’avoir expliqué les conditions dans lesquelles Karim Wade a été exfiltré par ses agents. Ce qui lui a valu une demande d’explication suivie d’une traduction en Conseil d’enquête. La tutelle a invoqué l’article 18 de la loi 72-23 du 19 avril 1972, relative au statut du personnel de l’Administration pénitentiaire pour l’envoyer ailleurs.
La mutation de l’inspecteur Mamadou Lamine Loum a été décidée par la tutelle, suite à une série d’évènements survenus à Rebeuss : évasions de deux pensionnaires et grève de la faim de détenus. Il avait emporté son adjoint, le chef de cour ainsi que le greffier d’alors de la prison. A la Maison d’arrêt et de correction pour femmes de Rufisque, l’ex-directrice A.M a été mutée, suite à l’évasion de trois narcotrafiquants, à savoir : une Sud-africaine, une Ghanéenne et une Nigériane qui purgeaient, chacune, une peine de 10 ans de travaux forcés. C’était lors de la journée sans femmes en prison décrétée par le régime de Wade, en janvier 2012. Avoir «manqué à ses obligations de vigilance et de contrôle» lui a valu cette sanction administrative, alors que ses complices ont été mis aux arrêts et condamnés. Il en est de même pour l’ancien directeur de la prison de Diourbel, suite à l’évasion de Baye Modou Fall alias Boye Djinné. Mais également de l’ancien régisseur du camp pénal de Koutal, Baba Lissa Niang, emporté par une grève de la faim des pensionnaires de ce pénitencier. La même mesure conservatoire a été prise suite à des évasions et mouvements d’humeur constatés dans plusieurs autres établissements pénitentiaires du pays.
Curieusement, le même traitement n’est pas infligé aux actuels responsables de Rebeuss, incriminés (à tort ou à raison) dans des faits plus graves : une mutinerie ponctuée de mort d’homme. Pourtant, plusieurs éléments accablent les matons. D’abord, les responsables de la prison de Rebeuss ont été au courant du mouvement d’humeur des détenus, plusieurs jours auparavant, mais ils se sont abstenus d’en aviser la hiérarchie à temps. Ainsi, le fait que les autorités judiciaires n’ont pas été avisées au moment opportun, à savoir le procureur de la République et le directeur de l’Administration pénitentiaire, a occasionné une dégénération de la situation. Laquelle est exacerbée par le fait que les matons en chef ont eu vent de la protestation des prisonniers, deux semaines avant la survenue de la mutinerie, comme en atteste les nombreuses alertes des organisations de défense des droits humains relayées par les médias.
L’audition des matons, par les limiers de la Dic, a aussi permis de savoir qu’une dizaine d’élèves-adjudants ont été déployés sur le terrain, pour encadrer la mutinerie. L’arrivée des renforts a permis de limiter les dégâts, avec notamment le Groupement d’intervention de la gendarmerie nationale (Gign), les Eléments pénitentiaires d’intervention (Epi) et la police. Si les matons en chef ont fait recours à des agents inexpérimentés pour mater la rébellion ouverte, c’est en raison des mutations des anciens gardes de Rebeuss, vers d’autres établissements pénitentiaires du pays. Ce qui soulève un autre débat : les décisions impopulaires prises par le nouveau directeur de l’Administration pénitentiaire expliquent la grogne des détenus.
Toujours au chapitre des responsabilités, une réunion a été tenue entre la directrice du pénitencier de Rebeuss, l’Inspecteur régional de l’administration pénitentiaire de Dakar et d’autres gradés de ce corps paramilitaire. Celle-ci a permis de recueillir toutes les doléances des détenus à l’origine de la grève de la faim sévèrement réprimée. Mais les conclusions n’ont jamais été transmises à la hiérarchie à temps. Un autre témoignage a intéressé les enquêteurs : celui de l’émissaire des détenus, l’ex-bagnard Ibrahima Sall alias «Yves». A la question de savoir pourquoi la directrice de Rebeuss n’a pas avisé à temps la hiérarchie, sa réponse est sans équivoque : «C’est pour éviter une éventuelle répression qui allait exacerber la tension».
En dernière analyse, des contradictions manifestes ont été relevées entre le rapport des faits produit par l’Administration pénitentiaire et les investigations menées par la Dic. Devant un tel constat, la question est de savoir si la Dic va se limiter à valider le rapport déjà fait par les matons en chef. Et quelle direction va prendre l’enquête confiée aux hommes du commissaire Ibrahima Diop? Demain fera jour…
